Why Make a Will?

It's easy to put off making a will. However, if you die without one, your assets may be distributed according to the law rather than your wishes. If you are not married then your parents or siblings could inherit rather than your cohabitee.

If you have children from a previous relationship you should determine how much of your estate they should receive.

Many of our clients contact us if they are going into hospital for a major operation. It is at this point they realise that they either have no will or their current will is out of date.

Many clients travelling overseas for work or on holiday contact us at the last minute realising that they don’t have a will in place. We are used to taking Will instructions on an urgent basis and can visit you at home or in a hospital or hospice setting. If you are busy at work preparing for your overseas trip we can also offer you a telephone or Teams appointment. You don’t even need to leave your desk.

Is Your Will Out of Date?

Did you know that we offer a FREE REVIEW of your existing will?

It doesn’t matter if your will was drafted by another firm, we are quite happy to take a look at it for you. If it is still suitable for your needs then we will advise you that there is no need to change it. We can also store your will, deeds and Lasting Powers of Attorney FREE OF CHARGE. You may find that your bank or building society are charging you for storage.

Our Will Solicitors have found that many clients do actually need to change their wills. A very common reason is that you haven’t seen your friend or neighbour for years, you have lost touch but they are mentioned in your will. Do you still want to leave them something in your will? Are they a suitable person to have as an Executor. Don’t forget, it is a very onerous task to be an Executor. Are you asking too much of someone who could no longer cope with huge amounts of paperwork?

Have any of the following events occurred since you made your will? If so, you should consider making a new will:

  1. If you married after the date of your will it will be automatically revoked (unless made in contemplation of the specific marriage).
  2. If you divorce, have your marriage annulled, or declared void, or if your civil partnership is dissolved after the date of your will. In most cases any appointment of your former spouse/civil partner as executor or trustee will no longer be appropriate.
  3. If you change your name or anyone mentioned in the will changes theirs.
  4. If an executor or trustee dies or becomes unable/unwilling or unsuitable to act e.g. If they have Dementia/Alzheimer’s or if they have moved abroad.
  5. If you have specifically bequeathed any item/property which you then sell or which changes in nature.
  6. If your estate increases considerably in value advice may be required with regard to inheritance tax liability and ways to minimize this during your lifetime.
  7. If you wish at any time to revoke or amend any clause in your will.
  8. If you acquire assets in a foreign country or make or amend a foreign will.
  9. If you have children who have not been provided for in your will.
  10. If a beneficiary has developed an illness that requires them to be cared for in a care home. This would require specific advice.

Do You Want To Store Your Will or Deeds Free of Charge?

Whenever we draft a will for a client we also store that will for them FREE OF CHARGE. Our will solicitors provide our clients with a copy to keep at home. It is important that your will is stored safely. You do not want your original will to be damaged by fire, mice or water. You do not want it to be ripped and you especially do not want anyone tampering with it or destroying it for their own benefit.

As well as storing wills we also store deeds,  Lasting Powers of Attorney and copy Funeral Plans FREE OF CHARGE for our clients.

Our Will Solicitors have found that clients often forget where the original of their will is or who drafted it. Therefore we decided that it was a good idea to write to every client annually for whom we are storing a will. That way your family will know where to find your original will if anything happens to you.


Do You Have a Funeral Plan Lying Around Your House?

If you have a pre paid funeral plan does anyone know about its existence other than the company who sold it to you? I ask this because pre paid funeral plans are one of the first things that I have to look for when a client dies and I am dealing with their estate.

We often arrange the funerals of my clients. If there is a pre paid funeral plan and nobody knows about it then your family may end up paying for a funeral when they don't need to do so. You can only use a pre paid funeral plan with the funeral company named in the policy.

If you do have such a plan then please alert relevant family and friends. You could also bring it into our office for FREE storage and we will provide you with a photocopy to keep at home or to give to your friends or family.

We find that storing a pre paid funeral plan for our client’s will is a good way of helping to organise things in order to help your family or friends later.
