Probate is an order of the court which grants you the authority to deal with the estate of the deceased. Here at Emmersons, we provide expert Wills and Probate Solicitors in Newcastle upon Tyne and Probate Solicitors in Sunderland. There are two types of Grant of Representation:
A Grant of Probate – you can apply for this if you are an executor named in the will.
Letters of Administration – you can apply for this if the deceased did not leave a will and you are the next of kin.
It is important for you to understand that if you are applying for a Grant of Representation, then you become legally responsible for the administration of the estate.

Do not worry if you do not live near either of our offices. Many of our Probate clients live throughout the United Kingdom and indeed right across the world.
By way of example, we were contacted by a client who had just flown in from America for his mother's funeral. Because of commitments back home, he was only in the UK for a very short period of time. He gathered all of the paperwork that he could and handed us the keys to his mother's home. Our client returned to America. We immediately arranged with a funeral director that they would be paid directly from the deceased's bank account thus meaning that her son did not have to worry about finding the money to pay for his mother's funeral.
We also arranged empty house insurance, brought in a cleaning team to clear out the house, clean the house and attend to the garden. We were able to deal with an Estate Agent who found a buyer. We also dealt with all finances including sorting out utility bills, pensions, savings and loans. We applied for Probate and thereafter distributed the proceeds of the estate to our client in America. He was extremely grateful as he did not have to attend to anything else once he had contacted us in the first instance. This was important to him as he was trying to come to terms with the sudden death of his mother.
How can we help? Our Expert Probate Solicitors can:
Our Expert Probate Solicitors provide:
If you have a pre paid funeral plan does anyone know about its existence other than the company who sold it to you? I ask this because pre paid funeral plans are one of the first things that I have to look for when a client dies and I am dealing with their estate.
We often arrange the funerals of my clients. If there is a pre paid funeral plan and nobody knows about it then your family may end up paying for a funeral when they don't need to do so. You can only use a pre paid funeral plan with the funeral company named in the policy.
If you do have such a plan then please alert relevant family and friends. You could also bring it into our office for FREE storage and we will provide you with a photocopy to keep at home or to give to your friends or family.
We find that storing a pre paid funeral plan for our client’s is a good way of helping to organise things in order to help your family or friends later.
If your loved ones live far away, we can act as Executors of your Estate when you die. We are experts in Probate matters and frequently act on behalf of the estates of our clients. Our award-winning team of Solicitors, as well as our clean and clear team, will ensure that all matters regarding your Estate are dealt with professionally, respectfully and in good time. We will advocate for your wishes and will distribute your Estate as instructed.

"I would like to place on record my considerable satisfaction with the way your Lawyer has dealt with the matter of my late brothers estate.
I am 72 years of age and have no previous experience dealing with this kind of thing. I found your Lawyer to be excellent in explaining the various stages of the actions involved and how these fitted into the overall picture. Throughout I felt confident that I could rely on her to deal with everything as needed and to keep me in touch with how things were going.
I found your Lawyer to be a friendly and easy person to deal with, which is more than mere courteousness, and much valued at a difficult time in my life."
