Are Divorce Assets Divided 50\/50?

In a recently reported case, the Court of Appeal, the second highest Court in the land, effectively decided that the lion\u2019s share of the assets which built up during the course of a \u2018short marriage\u2019 should be apportioned to the largest financial contributor. This is a fairly significant departure from the general starting point of equal division (i.e. a 50\/50 split) in relation to assets accumulated during a marriage.<\/p>\n

Usually, the Family Courts take the view that the various marital contributions of spouses should be treated equally (regardless of whether they are \u2018financial\u2019 or \u2018domestic\u2019 contributions), and should, therefore, result in an equal entitlement to assets accumulated over the course of the marriage. That is to say, the contribution of a \u2018homemaker\u2019 is regarded as just as important as that of a \u2018breadwinner\u2019.<\/p>\n

In the recent case of Sharp v Sharp [2017], however, the decision was that the distribution of assets should be skewed in favour of Mrs Sharp, as she had made a substantially larger contribution to the property which had been amassed over the course of her 4-year marriage to Mr Sharp. Mrs Sharp had earned bonuses from her trade in the amount of \u00a310.5m, and by the time of separation, the Pot totalled ~\u00a37.0m.<\/p>\n

The key factors which the Court appears to have taken into account in reaching this conclusion are:<\/p>\n

    \n
  1. The \u2018shortness\u2019 of the marriage;<\/li>\n
  2. The fact that this was a \u2018dual incomes\u2019 case \u2013 which is to say that it was not a traditional breadwinner\/homemaker case, whereby one spouse worked whilst the other cared for their children;<\/li>\n
  3. The fact that the parties had arranged their finances separately \u2013 each of them having their own separate bank accounts \u2013 and were financially independent;<\/li>\n
  4. The relatively meagre contributions made by the Husband in comparison to the Wife.<\/li>\n<\/ol>\n

    The Court did not comment on how long parties must be married until their marriage is no longer considered to be \u2018short\u2019; however, the marriage in question had lasted just 4 years, which would suggest that the principles set out in the case apply to marriages shorter than this.<\/p>\n

    The case is an example of one of many special circumstances in which the Family Court <\/a>has shown a willingness to depart from the \u2018yardstick of equality\u2019.
