At Emmersons Solicitors, we like to take a holistic approach to our will writing, in fact we are not just writing wills we are pre-empting some of the largest issues that may arise for a family. We understand that you can buy an off-the-shelf will from a stationer’s shop or download a Do It Yourself Will from the internet. However, our aim is to offer you a bespoke will, something that will work for you and your family for a long time to come.
Imagine the outcome for Steve, he has a sixteen year old son from his marriage, a girlfriend with whom he lives; her two children are also living in the same house as Steve. Now imagine he tries to draft a will himself. He might decide to leave part of his will to his son from his marriage and part to his girlfriend. “Great” he thinks, “job done, saved myself a fortune in solicitors fees”.
Fast forward two years and Steve dies in an accident. His wife goes to see her solicitor, she wants her share of Steve’s estate for herself, she isn’t interested in Steve’s girlfriend or her kids. As far as she is concerned everything should be hers, she was still married to Steve.
Steve’s son has just turned 18, he wants to rely on the will. He has recently fallen out with his mother and he needs to find a home for himself, he needs money fast. His mother on the other hand doesn’t want him to have any money yet. Even though they have fallen out she thinks it would be better if she got all of the money and put some aside for when her son is older.
Then there is Steve’s girlfriend, she wasn’t working, Steve had looked after her and her children for years. She wants her share of his estate.
Ultimately this case could end up in court, there are so many competing interests. Steve didn’t provide properly for his wife, she has a claim against his estate. If this case came before the court it would be a lot of heartache whilst everyone tried to prove that they were more worthy than the next person in the case. It would also cost, I would say, a minimum of £10,000 in legal fees, months of court proceedings and a huge amount of heartache for all concerned.
So, what a saving Steve made. A few hundred pounds at most and he could have had the RIGHT legal advice. Everyone would have been considered and in accordance with the law.
It obviously takes time to do this properly from a solicitor’s point of view. That is why we don’t sell on price but rather on the very important service we offer, that is fit for your purpose. The other thing that we are able to offer our clients is follow up advice, does that well known stationer make itself available for the odd legal query here and there?
Whilst we can’t look into a crystal ball and plan for every outcome in your life we can certainly cover many issues. Our aim is to offer you a will that looks to the needs of the next generation. The idea is that you don’t have to have your will rewritten every time there is a major change in your life.
Rachel and Ed have just bought their first house. They are getting married in two months time and don’t yet have children. They have sensibly decided to make a will now. In this case we can make the will in contemplation of their forthcoming marriage, we can provide for any children they may have and we can even appoint people to look after those children in the event that the couple die whilst the children are still minors. That’s a lot of life covered in two easy appointments at a solicitor’s office.
In the example of Steve above, his family were frankly very lucky to even find his will. The number of people I meet in my office who have made a will and don’t know where the original is astounds me. What if it’s out of date? You left everything to your ex partner who you haven’t seen for years, you left £20,000 to your kindly neighbour but you haven’t heard from them for years?
When we draft a will for our clients we keep the original, we send a copy to our client with instructions for their family as to how to access the original when it is needed. That way no one can tamper with the will, it won’t be destroyed, or ripped, or damaged in a flood, or eaten by mice! The list of things that can go wrong if a will is stored at home would be enough to fill a very interesting book of skulduggery.
