Why you should instruct a solicitor to handle your divorce

If you are contemplating a divorce or separation, and wondering whether you need a solicitor to assist you, then this article will help you decide. It will show you some of the pitfalls of a “Do-It-Yourself divorce” and how getting the right advice could save you time and money and help reduce the stress and anxiety often associated with divorce and separation.

There are many reasons why it is better to seek early help from a solicitor rather than trying to muddle through on your own. There is not time to cover them all here but the following examples may well help you, a member of your family or a close friend.

1. To Ensure That You Get a Fair Deal.

Getting a Fair Deal is what most people seek when they are divorcing. But how do you know that the settlement you are attempting to reach with your husband or wife is fair? Have you been railroaded into a deal to keep the peace? Have you been told that this is all that is available to you?

It is essential that you have full knowledge of all assets available either now or in the future. Has your spouse hidden assets from you? Are they about to receive a bonus or share deal from work that they have not mentioned? Do you know how to read their company accounts properly?

I am frequently asked about the value of instructing an expert solicitor to handle a divorce. I have put together this useful guide which will answer many of your questions. In a case that we dealt with at Emmersons Solicitors recently, we uncovered the fact that whilst our client was told her husband’s business was struggling, in fact his new partner had been placed on the books and they were being paid as a member of staff. Thus profits went down but the income was still going into the husband’s household. Notably this “employee” was paid as much as our client’s husband.

In another case, we alerted our client to property transfers that clearly showed our client’s spouse had given away a house to another family member just before advising our client that the marriage was over. This was one of a number of investment properties. We picked this up right at the start of the case using our immediate and online access to Land Registry documents. We then took steps to prevent the further dissipation of assets until it was possible to reach a final settlement in our client’s case. Thus protecting over a hundred thousand pounds of assets.

It is quite amazing what we have uncovered over the years because we know what we are looking for. The secret house or houses. In one case housing another “wife” and a child. The secret business, the offshore investments, the secret pension. In each case our client was blissfully unaware of what was really going on. If your marriage is at an end then you may well be worried about your financial future. But would you know how to improve or protect your financial situation?

If you don’t know which assets are really available, you may not receive a fair settlement. If you are attempting to undertake your own divorce, there may be numerous assets of which you are unaware, and this could lead to you losing tens of thousands of pounds. 2. To Keep You Away From Stressful and Costly Court Proceeding

The court process follows its own timetable and rules and you have to fit in with this. It can be very daunting, particularly if you are doing your own divorce. It can also take quite some time to reach a settlement. Did you know that it takes sixteen weeks to reach the first appointment from the point when proceedings are issued? The court fees are also rather hefty.

So how can this be avoided?

If you seek legal advice as soon as you are aware that there is a problem then you will feel better prepared. Our aim is to present you with basic options at your first appointment. We will provide you with a list of everything you need in order to move your case forward faster. This allows us to start swapping critical information with your husband or wife and their solicitor.

Instead of going to court we could either start negotiations by letter/email/telephone. Or, and we encourage this if you can cope with meeting your husband or wife, we arrange Round-Table Meetings. We ask you what it is that you need to discuss first. If the most important thing to you right now is where you will live and how you can afford that as a couple then that is what we will discuss.

It can usually take only two Round-Table Meetings to settle your case. We can often finalise a case long before a court could have it listed for a first hearing.
